Welcome to Vite. These Terms of Service ("Terms") govern your use of the Vite mobile application and services (the "Service"), operated by Fathi Abdelhakim Jaafar, trading as Vite in Djelfa, Algeria ("Vite", "we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service. Your use of Vite is also governed by our Privacy Policy.
Vite is a platform that connects customers who want to order food, restaurants that prepare it, and delivery drivers who deliver it, within the Djelfa area. Vite acts as an intermediary that facilitates these orders and deliveries. The restaurants are responsible for the food they prepare; drivers are responsible for carrying out deliveries.
You must be at least 18 years old and able to form a binding contract to use the Service. The Service is currently available only within the Djelfa delivery area; orders outside the supported zone cannot be fulfilled.
You agree to provide accurate information, keep your login credentials secure, and accept responsibility for activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms or are used for fraud or abuse.
We aim to deliver within the estimated time shown, but delivery times are estimates and not guarantees. Factors such as restaurant preparation time, driver availability, weather, and traffic may cause delays. During an active delivery, your delivery address is shared with the assigned driver, and you and the driver are each shown the other's phone number so you can call one another to coordinate the delivery. This contact information is available only while the delivery is active.

If you use Vite as a restaurant or driver, you additionally agree to fulfill orders and deliveries in good faith, comply with applicable food-safety, transport, and licensing rules, and provide accurate information. Vite may remove restaurants or drivers who fail to meet quality or conduct standards.
Restaurants are solely responsible for the preparation, quality, safety, and accuracy of the food they provide. Vite does not prepare food and is not responsible for food quality, allergens, or restaurant errors, though we will reasonably assist in resolving issues. The Service is provided "as is" and "as available", without warranties of any kind, to the fullest extent permitted by law. We do not guarantee that the Service will be uninterrupted, error-free, or that orders will always be fulfilled.
To the fullest extent permitted by applicable law, Vite and its operator will not be liable for indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for any claim relating to an order will not exceed the value of that order.
The Vite name, logo, app, and content are owned by Vite and its operator and are protected by applicable law. You may not copy, modify, or distribute them without permission.
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or use the Service unlawfully.
We may update these Terms from time to time. We will post the updated version in the app with a new "Last updated" date. Continued use after changes means you accept the updated Terms.
These Terms are governed by the laws of the People's Democratic Republic of Algeria. Any dispute will be subject to the competent courts of Djelfa, unless applicable law requires otherwise.
These Terms are drafted in English. In the event of any discrepancy between the English version and any translation, the English version shall prevail.
All prices, fees and amounts displayed in the Vite application are expressed in Algerian Dinars (DZD / DA). Vite operates on a cash-on-delivery basis only. Payment is made in cash, in Algerian Dinars, directly to the delivery driver at the time of delivery.
If any provision of these Terms is held to be invalid, illegal or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.
Vite shall not be liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, civil unrest, strikes, epidemics, government action, failure of telecommunications or internet networks, or interruption of electricity supply.
You agree to indemnify and hold harmless Vite, its operator and its representatives from any claim, loss, liability or expense arising from your breach of these Terms, your misuse of the service, or your violation of any applicable law or the rights of any third party.
You may not assign or transfer your rights under these Terms. Vite may assign or transfer these Terms, in whole or in part, to any successor entity or acquirer of its business, upon notice to you.
By creating an account, you consent to receive operational notifications from Vite relating to your orders, deliveries and account, including push notifications on your device. These are necessary to provide the service. You may disable push notifications at any time in your device settings or in the notification preferences within the app; doing so may prevent you from receiving timely updates about your orders. Vite does not send marketing notifications without separate consent.
